COSTS
In the case of the trademark application, the application fee is initially paid during the application, secondly, the registration certificate fee is paid after the decision of grant. There is approximately 7-8 months between the payment of the official application fee and the payment of the official registration fee. Trademark costs are calculated as follows:
Total application cost = (number of classes) x Official fee for 1 class + Attorney fee + V.A.T. (Value Added Tax)
Registration certificate cost = Official fee + Attorney fee + V.A.T
DURATIONS
In trademark registration, the period from the application to the receipt of the registration certificate varies. In contrast, we can give average times below.
PHASES FROM APPLICATION TO GRANT
1-Application: 1 day
2-Similarity Search: A similarity search is conducted by the Turkish Patent and Trademark Office for a period ranging from 1 to 3 months and the results are notified to the trademark owner.
3-Publication: The publication period is 2 months. At the end of the 2-month period, if there is no opposition to the trademark application, the Turkish Patent Office shall notify the applicant of the acceptance letter.
4-Grant: The publication period is 2 months. At the end of the 2-month period, if there is no opposition to the trademark application, the Turkish Patent Office shall notify the applicant of the acceptance letter.
5-Registration Certificate: After the payment of the trademark registration certificate fee to the Turkish Patent and Trademark Office, the Office prepares and submits the trademark registration certificate within 1-1.5 months.
THINGS TO BE DONE AFTER REGISTRATION
6-The protection period of the trademark is 10 years. After registration, close to the end of this 10-year period, the trademark renewal process should be done in the Turkish Patent Office.
7-The patent attorney notifies the trademark owner that the 10-year protection period of the brand is over, within a reasonable period before the due date.
8-If the trademark owner wishes to renew the trademark, the trademark renewal fee shall be paid to the patent attorney.
9-Patent attorney pays official renewal fee to Turkish Patent Office.
10-The Turkish Patent and Trademark Office prepares the trademark renewal certificate and sends it to the patent attorney.
11-The patent attorney sends the renewal certificate to the trademark owner. Thus, the trademark owner has acquired a new 10-year protection.
REQUIRED DOCUMENTS
1-Power of Attorney: The trademark applicant gives a patent attorney a power of attorney stating that he is authorized to represent before the Turkish Patent and Trademark Office.This power of attorney does not have to be notarized. Only in case of abandonment and withdrawal of the trademark right, the power of attorney is expected to be notarized.
2-Trademark Logo: The trademark is not required to have a logo. The trademark may also be just a word mark. If the trademark has a logo, it must be submitted to the Turkish Patent and Trademark Office in 825 pixels x 825 pixels format as an electronic image file.
3-Information about the applicant: If the applicant is a natural person, name, surname, address, phone number, e-mail, etc. should be given. If the applicant is a company, information such as company title, tax office and number, address, telephone and email should be given.
4-Official fee payments: Official fees must be paid in advance or at the time of application. For this purpose, a bank transfer is made to the bank accounts of the Turkish Patent and Trademark Office and the receipt information is entered during the application to the Turkish Patent Office. In addition, during the trademark application, the official fee payments can be made by credit card.
